Terms and Conditions Store Business

§ 1 Scope and period of validity

(1) The terms and conditions are part of all current and future business relationships between the customer and Second Hand Yasmini, owner Fadila Oulghazi.

(2) Second Hand Yasmini reserves the right to update, expand or change the terms and conditions at any time and to publish and identify the newer version as a display in the shop and on www.yasmini.de. When new terms and conditions are published, this version loses its validity.

§ 2 Duration of the commission contract

(1) The commission contract is concluded for a period of 3 months, as long as it is not expressly extended.

(2) The subsequent custody agreement is concluded for a period of one month.

§ 3 Acceptance of the goods

(1) Second Hand Yasmini takes over the sales mediation of the customer's goods for three months. We keep the goods during this time and offer them for sale to third parties. We undertake to sell the goods in our own name for the account of the customer. 

(2) We reserve the right to reject goods in whole or in part without justification. The customer hands over the goods to us for sale and assures that they are his unrestricted property. The goods do not become the property of Second Hand Yasmini - they only entitle Second Hand Yasmini to sell the goods provided.

(3) Second Hand Yasmini calmly checks the goods with regard to their properties and their saleability and enters all data in the list of goods, which is then forwarded to the customer by email. If this list of goods is not objected to within 2 days or if it is not picked up, this is the basis of the contractual relationship.
 

(4) In the case of branded goods, we only accept originals. The customer assures that this is genuine branded goods and that there is no infringement of trademark and/or plagiarism law. The owner of the goods is liable for all civil claims that may arise from the sale of counterfeits. We reserve the right to claim recourse from the customer in the event of damage. After selecting the consignment items, a detailed bill of lading is created.

§ 4 Condition of the goods

(1) Since we want to ensure good quality of goods, we have the following rules:

a) The clothes

- must be in very good to good condition, - must have been washed and ironed, - must not be stained or overly faded, - must be free from odors and defects such as missing buttons or broken travel ties.

b) shoes

- must be new and absolutely new, - must only have very minor signs of wear, - must be clean and cleaned.

c) commodities

- must be clean, functional and complete.

(2) If the goods do not meet the acceptance conditions, they will not be accepted. We reserve the right, even after acceptance of the goods, to sort out goods that do not comply with the rules. These are to be picked up by the customer.

(3) The owner of the goods declares not to conceal any defects known to him and confirms that they are free of defects. In the event that the goods are free of defects, he undertakes to indemnify and hold harmless vis-à-vis third parties. The goods will not be checked for defects by Second Hand - Yasmini under any circumstances.

(4) Items that fall under the Youth Protection Act may not be offered.

§ 5 Liability  

(1) We are only liable for the care we take for our own affairs.

(2) Second Hand Yasmini assumes no liability for burglary, fire and mains water damage, or force majeure. Further liability for theft, damage or soiling by third parties is also excluded.

§ 6 The commission business

(1) Second Hand Yasmini carries out the commission business in its own name and for the account of the customer.

(2) We shall pay the statutory value-added tax on the proceeds from the sale.

(3) After the end of the commission period, the customer is entitled to 40% of the gross sales proceeds.
 

(4) The sales price is calculated by Second Hand Yasmin, wishes regarding the price are to be expressed by the customer upon delivery.
 

(5) If dirt or defects are found after acceptance, these goods will not be sold, or Second Hand Yasmini reserves the right to reduce the sales price by 20% without consulting the supplier.
 

(6) The sales proceeds are paid out after the contract has expired; payment during the contract period is a matter of goodwill.

§ 7 procedural transaction

(1) The customer undertakes to collect the goods without reminder after the end of the contract.

(2) The customer is obliged to track the end of the contract himself.
 

(3) After the end of the commission contract, Second Hand Yasmini will keep the goods for 1 month. During this time, you are still entitled to sell the goods on consignment.

(4) At the end of the storage period (1 month after the end of the commission contract), the goods become the property of Second Hand Yasmini and will be resold, disposed of or used for charitable purposes at its own discretion.
 

§ 8 Statute of limitations

The customer is entitled to the proceeds from the sale. The customer's claim against Second Hand Yasmini for the return of what has been received, i.e. the money, expires within 12 months after the agreed storage period has expired.

§ 9 Premature Collection of Commission Goods

If the customer demands his goods back in whole or in part before the end of the commission period, Second Hand Yasmini can demand reimbursement from the customer for the expenses he had in the course of the transaction, § 396 Para. 2 HGB. These include above all costs for the use of storage rooms and costs for the transport of the goods. A fee of 20% of the specified value of the goods is charged here and is due for payment before the goods are handed over. An appointment must be made for this in advance.

§10 Warranty

Since this is a sale from private to private and Second Hand Yasmini acts as an intermediary, a warranty and guarantee are expressly excluded. With the purchase, the buyer accepts the offer as seen and described. The quality of the goods is then deemed to have been agreed. Goods on commission are non-returnable.

The following terms and conditions apply to all orders via our online shop. Our online shop is aimed exclusively at consumers.

 

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. Entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

The purchase contract is concluded with Yasmini.

 

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the order button. Immediately after sending the order, you will receive another confirmation by e-mail.

4. TERMS OF DELIVERY

 

Shipping costs are added to the stated product prices. You can find out more about the amount of shipping costs in the offers.

 

In principle, you have the option of collecting the goods from Yasmini, Marburger Straße 6, 60487 Frankfurt am Main, Germany during the following business hours: Mon - Fri 10:00 a.m. - 5:00 p.m. and Sat 10:00 a.m. - 2:00 p.m

 

We do not deliver to packing stations.

 

 

5. PAYMENT

 

The following payment methods are generally available in our shop:

 

Payment in advance

If you select the payment method in advance, we will give you our bank details in a separate email and deliver the goods after receipt of payment.

 

PayPal

In order to be able to pay the invoice amount via the payment service provider PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal and identify yourself with your access data and confirm the payment order. The payment transaction is carried out by PayPal immediately after placing the order. You will receive further information during the ordering process.

 

Cash on pickup

You pay the invoice amount in cash upon collection.

 

 

6. DAMAGE IN TRANSIT

 

If goods are delivered with obvious transport damage, please report such defects to the deliverer as soon as possible and contact us immediately. The omission of a complaint or contact has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

 

 

7. WARRANTY AND GUARANTEES

8. LIABILITY

 

We are always fully liable for claims based on damage caused by us, our legal representatives or vicarious agents

 

  * in the event of injury to life, limb or health,

  * in the event of intentional or grossly negligent breach of duty,

  * in the case of a promise of guarantee, if agreed, or

  * as far as the area of application of the Product Liability Act is open.

 

In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and the observance of which the contractual partner may regularly rely on (cardinal obligations) due to slight negligence on the part of us, our legal representatives or vicarious agents, the liability is limited to the amount foreseeable at the time the contract was concluded Damage limited, the occurrence of which must typically be expected.
